Documents

Identification

You will be required to present a valid government-issued ID and provide the following information: full name, occupation, date of birth, telephone number, and residential address. Copies must be prepared in advance, and originals will be required for verification.

  • 1. What is the Statutory Declaration of Common-Law Union?

    This is an official document (Form IMM 5409) required by Immigration, Refugees and Citizenship Canada (IRCC) where you and your partner swear under oath that you have lived together in a conjugal relationship for at least 12 continuous months.

  • 2. Why do I need a Notary Public for this form?

    Because the form is a statutory declaration, you cannot simply sign it yourselves. It must be signed in front of a licensed Notary Public or Commissioner of Oaths who administers a formal oath and applies their official seal to validate it.

  • 3. What other documents do I need to prove our relationship?

    IRCC requires solid proof of cohabitation. This includes joint bank accounts, joint leases or mortgages, utility bills in both names, and official government mail sent to the same address.

  • 4. Can I get these supporting documents certified?

    Yes. If you are sending physical copies of important original documents (like a joint lease or birth certificates), a Notary Public can create "Certified True Copies" so you don't have to risk mailing your originals to IRCC.
